Terms of Service

1. Overview

These Terms of Service (“Terms”) govern your use of nextzyte.com and any project, quote, or service NextZyte (“we,” “us,” “our”) provides to you (“client,” “you”). By submitting a quote request, paying a deposit, or otherwise engaging our services, you agree to these Terms.

2. Services

We design and build websites for businesses, offered in the project types described on our Pricing page (Launch, Growth, and Custom). Specific scope, page count, features, and timeline for your project will be confirmed in a written quote before work begins.

3. Free mockup

Before any payment, we may provide a free homepage mockup concept. This is non-binding — you’re not obligated to proceed, and we retain ownership of the mockup design unless and until a paid project moves forward.

4. Pricing, deposits & payment

  • A fixed price is agreed before work starts, based on your project’s scope.
  • A deposit (shown per tier on our Pricing page) is due to begin work; the remaining balance is due on completion, before final handoff/launch, unless otherwise agreed in writing.
  • The deposit is non-refundable once work has started. If you cancel before work begins, your deposit will be refunded in full.
  • If payment is late, we may pause active work until the account is brought current.

5. Revisions

Each tier includes a set number of revision rounds, as described on our Pricing page. Additional revisions beyond what’s included may incur an additional fee, quoted before the work is done.

6. Timeline

Delivery timeframes listed on our Pricing page are estimates and depend on how quickly you provide content, feedback, and approvals. Delays on your end may extend the timeline accordingly.

7. Ownership

Once the project is paid in full, you own the final website (design, code, and content you provided) for your own use. We may display the completed project in our own portfolio/marketing unless you request otherwise.

If you’d prefer we not display your completed project in our portfolio, let us know in writing before launch and we’ll leave it out.

8. Content you provide

You’re responsible for making sure any text, images, logos, or other content you give us to use on your site is yours to use, or that you have permission to use it. You agree to cover us for any claim arising from content you provided.

9. Hosting & care plans

Optional monthly care plans (hosting, small content edits, uptime monitoring) are billed separately and can be canceled at any time after launch, as noted on our Pricing page. If you cancel your care plan, hosting continues through the end of the current billing period. After that, you’ll need to migrate the site to your own hosting — we’re happy to help with that transition.

10. Client responsibilities

You’re responsible for providing timely content (text, images, logos), feedback, and any necessary account access (domain registrar, existing hosting, etc.) needed to complete the project. Delays in providing these may affect the delivery timeline.

11. No guarantee of results

We’ll do our best work, but we don’t guarantee specific business outcomes (traffic, sales, search rankings, etc.) from a website alone.

12. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim related to a project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, or consequential damages.

13. Independent contractor

NextZyte provides services as an independent contractor. Nothing in these Terms creates a partnership, joint venture, or employment relationship between us.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. (Assumed based on your service area — let us know if this should be a different state.)

15. Severability

If any part of these Terms is found unenforceable, the rest will remain in full effect.

16. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted on this page.
